Terms & Conditions
Effective from 1 January 2026
These Terms & Conditions (“Terms”) govern your access to and use of the Imarat360 platform operated by Imarat360 (SMC-Private) Limited (“Imarat360”, “we”). By signing up, installing the app or otherwise using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement. By accepting these Terms, you represent that you meet these requirements.
2. Accounts
- You are responsible for keeping your login credentials confidential.
- You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorised access to your account at abdulahadmagsi1@gmail.com.
3. Subscription & billing
- Subscriptions are billed monthly or annually in advance. Annual plans are billed in full at the start of the term.
- All fees are in Pakistani Rupees (PKR) unless otherwise stated, and exclusive of applicable taxes.
- Failure to pay invoices within 14 days of the due date may result in suspension of the Service for the affected building. Data is retained for 90 days after suspension before deletion.
- We may change prices with at least 30 days' notice. Existing annual subscriptions are honoured at their original price until renewal.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to violate any Pakistani law including PECA 2016.
- Upload content that is defamatory, obscene, harassing or infringes another's rights.
- Attempt to reverse-engineer, decompile or extract source code from any part of the Service.
- Use the Service to send spam, phishing messages or unsolicited marketing.
- Probe, scan or test the vulnerability of our systems without prior written authorisation.
5. Your content
You retain ownership of all content you upload (documents, complaint photos, notices etc.). You grant Imarat360 a worldwide, non-exclusive, royalty-free licence to host, store and display that content solely for the purpose of operating the Service for your building.
6. Building admin authority
The union admin or president (the “Building Admin”) is authorised to manage the building's account, including adding or removing residents, posting notices, generating bills and viewing records. Residents are subject to the building's bylaws as enforced through Imarat360.
7. Service availability
We target 99.9% monthly uptime. Scheduled maintenance is announced in advance via the in-app banner. We are not liable for downtime caused by force majeure, third-party providers (AWS, telcos, payment gateways) or circumstances outside our control.
8. Intellectual property
All trademarks, logos, software, designs and content of the Service are owned by Imarat360 or licensed to us. You may not copy, modify or distribute any part of the Service without prior written consent.
9. Termination
You may cancel your subscription at any time from your billing settings or by emailing abdulahadmagsi1@gmail.com. We may suspend or terminate access if you breach these Terms, fail to pay, or engage in fraudulent or abusive behaviour.
10. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied. Imarat360 is a software tool — final responsibility for financial records, legal compliance and building operations remains with the Building Admin and society.
11. Limitation of liability
To the maximum extent permitted by law, Imarat360's aggregate liability arising out of or relating to the Service shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential damages.
12. Governing law & disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute shall be subject to the exclusive jurisdiction of the courts of Karachi.
13. Changes
We may update these Terms from time to time. We will notify you of material changes via email and the in-app banner. Continued use after the effective date constitutes acceptance.
